INDEMNIFICATION

Members agree to indemnify, defend, and hold harmless Growth Company Investor, its affiliates and suppliers from any liability, loss, claim and expense (including attorneys' reasonable fees) related to (I) members violation of this Agreement, and (ii) member's posting of material to the site. For all claims relating to Growth Company Investor's performance or non-performance, under this agreement, whether in contract, tort, strict liability or otherwise, including without limitation, claims for failure of the program/service to operate, in no event shall Growth Company Investor's liability, hereunder, whether arising in contract, strict liability or tort, exceed the fee, if any paid by the member for the program/service.

CHANGES TO GROWTH COMPANY INVESTOR AND THE AGREEMENT

Growth Company Investor may make improvements or changes to the information, services, products, and other materials on the web sites, at any time without notice. Growth Company Investor may modify this agreement at any time, and such modifications shall be effective immediately upon posting of the modified agreement. Members agree to review this agreement periodically, and member's continued use of the site shall be deemed acceptance of the modified agreement.

USE OF CONTENT

You may use the program/service and its content only for your personal, non-commercial use. You acknowledge that the program/service contains information, software, advertising and financial market information accessible through the site including without limitation all design, text, audio, images, news, and financial analysis and research and other financial market data as well as photographs, audio, and video clips, graphics, links and other material (collectively the content) that are protected by copyright, trademark or other proprietary rights of thewrongprice.com or third parties. You may download or copy the content only for your personal use, provided that you retain on such materials the copyright and other notices contained in such content. TERMINATION OF PROGRAM/SERVICE

Growth Company Investor reserves the right, in its sole discretion, to restrict, suspend or terminate your access to all or any part of the program/service, including the interactive areas, at any time for any reason without prior notice or liability.Growth Company Investor may change, suspend or discontinue all or any aspects of the Program/service at any time including the availability of any feature, database, or content without prior notice or liability

REFUND and CANCELLATION POLICY, AND DELIVERY RELATING TO PAID-FOR SUBSCRIPTIONS

In reference to subscription agreements between Growth Company Investor and its customers the refund policy is as follows: Customers submitting their details for a subscription to Growth Company Investor are agreeing to the following terms surrounding their subscription payments; Growth Company Investor takes payment for an annual subscription up-front, Growth Company Investor does not offer pro-rata refunds on subscriptions.

Renewal payments are automatic, and are collected on the same date each year. Please be aware of any price rise which may be applicable to the second year of customer subscriptions, and subsequent renewals, which are clearly outlined at the point where customers submit their details. Renewal payments are also annual, and we do not offer pro-rata refunds. Customers wishing to cancel their subscription must do so within the agreed subscription period, otherwise will be liable for the full year's subscription fee which is non-refundable. Similarly with regards to renewal payments, customers must cancel their subscription before the date automatic renewal is taken (annually on the same date each year after the first year's payment), otherwise are liable for the full year's subscription fee which is non-refundable. All customer cancellations received by the subscriptions team will be confirmed in writing. If customers do not receive their cancellation confirmation, they should contact the subscriptions department on 0207 250 7056.

The delivery of paid-for services is through a magazine delivered 10 times per calendar year to the home or work address supplied by the customer, the Growth Company Investor web site and direct emails. To find out more about how we use your details please refer to our privacy policy.

ENTIRE AGREEMENT

This agreement constitutes the entire and only agreement between Growth Company Investor. And the Member of Growth Company Investor, and supersedes any and all prior or contemporaneous agreement, representations, warranties, and understandings with respect to Growth Company Investor, the content, information, goods and services provided by or through Growth Company Investor sites, and the subject matter of this agreement.

JURISDICTION

This agreement and the resolution of any dispute related to this agreement or Growth Company Investor shall be governed by and construed in accordance with the laws of England, without giving effect to conflicts of law principles.

Growth Company Investor's failure to insist upon strict enforcement of any provision of this agreement shall not be construed as a waiver of any provision or right. Any legal action or proceeding between Growth Company Investor and the member of Growth Company Investor, related to this agreement shall be brought exclusively in the competent jurisdiction of the courts of England.

If at any time the terms and conditions of this agreement are no longer acceptable to you, you should immediately, cease all use of the program/service.

The Directors of Growth Company Investor Ltd accept responsibility for the contents of this website to the extent that they amount to an investment advertisement. The contents contain promotional material for a promotional purpose.

Any provision of this Agreement which is declared void or unenforceable by any competent authority or court shall, to the extent of such invalidity or unenforceability, be deemed severable and shall not affect the other provisions of this Agreement which shall continue unaffected.

PRIVACY POLICY

The information that you provide about yourself to thewrongprice.com will only be used in accordance with its Privacy Policy. The Privacy Policy does not apply to third party sites.

Terms & Conditions relating to MAXjet ticket and investment prize competition

The prize draw will take place on 15th November 2006. Winners of the first prize Maxjet tickets will have their details passed on to Maxjet so they are able to claim their prize. Winners of Maxjet tickets must book their tickets by 30 November 2007 for travel before 30 November 2007. Promotional tickets have no cash value. Promotional tickets are non-transferable, non-refundable and no changes are permitted after the electronic ticket has been issued. MAXjet operates point to point flights and is not responsible for any misconnection due to schedule changes or delays. Seats are limited and certain flights and/or days of travel may be unavailable, especially during busy travel periods. Flights are subject to change without notice, and other restrictions may apply. Winners of the second prize, £500 worth of investment goods, will be contacted by the Growth Company Investor team to be informed of the options. There is no cash alternative. Most of the goods on offer are published by Growth Company Investor Ltd.
